Organisers are solely responsible for the accuracy of the event information they provide on the Festivo platform, including dates, times, locations, pricing, and event descriptions.

Conditions of Using the Festivo Services

• You agree to provide accurate, current, and complete information when creating an account or making a purchase on Festivo.
• You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
• You agree not to use Festivo’s services for any unlawful or prohibited activities, including fraud, money laundering, or any activity that violates applicable laws.
• You may not use Festivo’s website to distribute spam, unsolicited advertising, or malicious content.

• Organisers agree to indemnify and hold Festivo harmless from any claims, losses, or damages arising out of or related to their events or activities.

Responsibility of the User

• Users must ensure the accuracy of the information they provide when creating an account or making a purchase.
• Users agree to comply with the rules and regulations set by the event organiser and the venue.
• Users are responsible for any charges, fees, or taxes associated with their purchases on Festivo.
• Users agree not to engage in any activities that may harm Festivo, organisers, or other users, including fraudulent activities, harassment, or misuse of the platform.

Types of Accounts Existing in Festivo

Festivo may offer different types of user accounts, including but not limited to:

2. Organiser Account: For individuals or entities that create and manage events on the Festivo platform.

3. Corporate or Agency Accounts: For businesses or agencies that manage multiple events or bookings.

Each account type may have different features, capabilities, and responsibilities. Additional terms may apply to organiser or corporate accounts, which will be communicated during registration or onboarding.

Organiser Account

• Organisers must provide accurate and verifiable information about their identity, business, and events when creating an organiser account.
• Festivo reserves the right to verify organiser information and request additional documentation, such as business licenses or identification documents.
• Organisers are responsible for managing their events, including event creation, ticket pricing, capacity management, and customer communication.
• Organisers must comply with Festivo’s policies, guidelines, and applicable laws when using the platform.
• Festivo may suspend or terminate an organiser’s account if it determines that the organiser has violated these Terms and Conditions or engaged in fraudulent or illegal activities.

Exclusive Account

Festivo may offer exclusive accounts or premium services to selected organisers or partners. These accounts may include additional features, promotional opportunities, or dedicated support.

The terms and conditions for exclusive accounts will be communicated directly to eligible organisers and may be subject to separate agreements.

Festivo reserves the right to modify, suspend, or terminate exclusive account benefits at any time, with or without notice, in accordance with applicable agreements.

Information Regarding the Organiser and User Relations

Festivo is not responsible for any disputes, issues, or disagreements between organisers and users. Any issues related to event quality, cancellations, rescheduling, or refunds must be resolved directly between the organiser and the user.

Festivo may, at its sole discretion, provide support or mediation in resolving disputes, but it is not obligated to do so.

Organisers are responsible for honoring their commitments to users, including providing the event as described, handling cancellations, and processing refunds where applicable.

Responsibilities regarding organising the event

• Organisers are fully responsible for planning, managing, and executing their events, including logistical arrangements, staffing, and safety measures.
• Organisers must ensure that the event venue complies with all relevant safety regulations and accessibility standards.
• Organisers are responsible for obtaining any necessary permits, licenses, or approvals required to host their events.
• Festivo is not responsible for any accidents, injuries, or damages that occur during the event or as a result of the event.

Bookings, prices, fees and payments

• All prices listed on Festivo are set by the organisers or in agreement with them and are subject to change without prior notice.
• Ticket availability is determined by the organiser and may be limited due to venue capacity, demand, or other factors.
• Payments for tickets or services are processed securely through third-party payment processors integrated with Festivo.
• Users are responsible for providing valid payment information and authorising Festivo or its payment partners to charge the applicable fees.
• Festivo may charge service fees, transaction fees, or other charges for the use of its platform. These fees will be disclosed to users at the time of purchase.
• All payments are subject to verification and anti-fraud checks. Festivo reserves the right to cancel or refuse any transaction that appears suspicious or fraudulent.

Refunds and cancellations

In general, tickets are non-refundable unless otherwise stated in the event’s terms and conditions.

In the event of cancellation, postponement, or significant change to an event, Festivo will follow the organiser’s instructions regarding refunds or exchanges.

Festivo is not responsible for any losses or damages incurred as a result of event cancellations, postponements, or changes.

Liability

To the maximum extent permitted by law, Festivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the website or services.

Festivo does not guarantee that events listed on the platform will occur as scheduled or that they will meet your expectations.

Festivo’s total liability for any claims arising out of or related to these Terms and Conditions or your use of the services shall be limited to the amount of fees paid by you to Festivo, if any, in the six (6) months preceding the event giving rise to the claim.
